We drew up papers and my husband and I signed and my mother in law and my nephew who is the executor for her. We are paying a monthly amount until the house is paid for. how to get out of a rent to own house lease? My husband and I jumped into buying a house in pa. At the time it seemed perfect. Perfect location and greatest investment. We at the time were waiting for our credit to imporve so we took a rent to own option. The house had a sign that said buy from owner when we bought it. After signing a 3 year lease with the option to buy we found out the house is ridiculously over priced and then while looking over the howard hanna realty website realied our house is still listed as an active house to buy....is this a breach of contract and should we be concerned about this??? We really would like to get out of this lease for many reasons plus our ill parents now need us closer to home. Any help woul be appreciated.

My husband is on contract for a new house but I own a condo in my name....? that is late 6 months in mortgage payments. My husband showed a Lease to Purchase Option to his lender (for a FHA loan) showing that the condo is being rented out in July so they know he is to live in the new house and is not attempting to buy it to rent it out. What would you do in this rent to own mess? My parents were recently in a contract that was rent to own. They have been in it for about two years. All along they have been getting letters from the bank saying that there was no payment on the house even though my parents were paying rent to the owners of the house. So a few more letters came in the mail like that one, but the owners said to disregard them and that they paid it. So, my parents who paid their rent early have two move with only two weeks notice. The owners won't answe the phone when my parents inquire about everything including keeping rent money for this month, even though they will only be there for two weeks and the owners don't even own the house anymore. What should be done in this situation?

The idea sounds good, and I have been aware of the lease purchase contract. What I'm wondering about is the mortgage a lease purchase tenant buyer would need. On a rent to own a tenant buyer would only put a small down payment on the house, say 2 or 3% of the purchase price. When they go to exercise their option to actually purchase, not just rent, do they have to put down an additional 20% to secure a mortgage like if they had got a mortgage in the first place?, Or is there a loophole for a no or low down payment because they've been showing a commitment to the house? Any input from lease 2 purchase investors or a mortgage professional would be greatly appreciated! Thanks
rent to own? My husband and I just started renting a home and we would like to own it eventually but we have a huge amount of debt and we can not get a loan for the house. We can afford the payments but we are not able to get a loan because of our debt to income ration. The landlord has given us the option of rent to owning so he could buy a house but he needs our down payment to use for his down payment on a new house. Wouldnt he need to keep my down payment in the bank so that we could use it once we are able to buy out right and do we have the papers on the house while we are paying him, so that way we can do things to the house. And how long do rent to own contracts usuelly last for, we have a 12 month lease up in Feb. so would it last until then or could we go longer because my husband will have a better job in 2 years and I dont want to miss this oppertunity. My credit is what they call "bruised" as I paid off about 40k in debt in 2000 and 2001. I know you probably think I shouldn't be getting a house if I was already that far in debt but between being a college student and prime target for cc companies and my parents dying before I went to college I needed to support myself in some way, anyway possible. See the thing is mortgage companies don't care about your sob story, they care about your credit rating. My landlord offered me the house we have lived in for 3 years for nothing down but on land contract. I am so confused on what I should do. 1 more thing to add is that I am a nanny but just stopped working for the summer and won't have a way to verify income to a lender (BA in 1 year). FI earns good money but he has no credit, besides the bills his mother turned on in his name and never pd (we took care of them but now is report has nothing on it...) I don't need to consolidate because I have no debt now, it's the damage I caused 6 years ago. So then everything starts dropping off and I am back to square one? This is getting frustrating....
rent to own home, breach of contract on sellers part question ? I'm renting to own a home from a person who has power of attorney over real estate for her mother in law. (person is my sister in law I thought I could trust). Been 4 months I've paid. $400 a month. Upon moving in, I fixed house up. Painted every room. Installed new electrical switches and cover plates in all rooms. Tore up nasty carpet & pad to reveal hardwood, new light fixtures, new counter top, ceramic tile floor in kitchen , new faucets in kitchen & bath, new shower surround. So $10,000 approx. equity into the house. She was to pay for all back taxes that were on payment arrangements with the money from the rent to own $. As stated in our contracts which are filed at county. I called to see if the payments were being made. They were not being paid and legal action will be taken (sherrif sale) This is pending, no action yet. She is in Breach of contract. I'm not going to pay $400 any more how long can I stay here without paying. mother in law will die and family can take house

I have heard of rent to own homes, lease purchase contracts, owner financing agreements, and land contracts. I was wondering if there are all in reference to homes for rent to own or if they can differ from transaction to transaction. Also, I have been having difficulty trying to find rent to own homes in California on my own and my realtor is pretty clueless. I was wondering if anyone had any suggestions on how I can do more research on rent to own and find more available homes.
Can a landlord keep a 10,000 down payment on a RTO home without a written contract? My daughter put 10,000 on a rent to own house she was renting. Stupidly, she gave this landlord 10,000 as a down payment and never got a signed contract. They had to move because the boyfriend lost his job. All they got back was the deposit and they also let them keep the new renters deposit because they felt bad that they didn't have any of the 10,000 left. Can they do this?

I am selling a house on a rent to own basis you might say? I owe 15 years on this house that I am tired of renting and need to sell it rather quickly. I have a lifelong friend who I trust very much and have agreed to sell him the house on monthly payments until he can get his credit cleaned up or a co-signer. Without going into a long story, his credit is in a mess because of his recent divorce from an ex-wife who ran up thousands of dollars of credit card bills, and other things shortly before she left him for another man. Anyway, I know I will get my money and I know he will eventually get all this cleared up, my question is... I want to protect myself and him by making up some kind of contract that we can each sign and have notorized. What kind of information do I need to include in this? I want a fair contract that protects the BOTH of us. Please offer suggestions. Oh and please, no answers involving NOT selling the house in this manner. Do you think its a good idea to rent to own my house back from a landlord? I'm about to lose my house for taxes and can't refinance because there is not enough equity in it, but it is a family home I want to save and a local landlord has offered to pay off my debts and taxes and in return, I will sign over the deed to the house to him and he will do a lease option where I rent to own for 3 years then get a mortgage to pay off the rest, thus saving the house and giving me time to get my credit rating improved. The problem is that I have heard really bad things about him doing this with people and then kicking them out of their house. I don't see how he can do this if it is done through a lawyer as he said it would and I have a seperate lawyer go over the contract. What do you think? Is it a good idea or not?

Me and my fiance' are currently renting a house for 475mnth but there is no chance of owning it in the future. plus the plumbing is messed up. we have an oppurtunity to rent-to-own a house for 550 a month but the man that owns it is still in the contract with a realator until february. we really need to get oout. the house is a fixer upper but at least we would be able to own it. would any of you take this offer. plus it comes with some land and he will let me have my dogs. only consern is that if someone wants to buy it before february then we have 90 days to get out. Realestate, rent-to-own question? Last year, I filed bankruptcy. this year, I had a voluntary reposession, next month I am planning on letting my house go on either foreclosure or short sale. I've missed 2 or 3 payments on my house, I've not missed any payments on my car payments BUT there is this guy who wants me to put 5 or 10 thousand dollars on a rent to own house and then the contract says buy it, or loose all the money I put towards it. Will my credit be okay to buy it? Or am I just wasting my money? Do you think I should just rent until my credit built back up? I used to have a 950 credit score, but because of a bad loan its to 550. Is it possible that this lady knows that I won't be able to get a loan in 5 years when the due date is so that i can purchase the house so that she will be able to keep the money? Or will my credit be better in 5 years?

If you break a rent to own lease and just rent a house, can you ever buy the house later? My husband and I have been in a rent to own for two years and the owners want to do owner financing. The real estate agents say that's fine but want $18000 up front for their commission. Neither party has that money so the real estate agents say we can either stay in the contract and try to get financing from the bank later or break the lease and just rent. They say if we break the lease though, that we will never be able to buy the house.... is that correct? That doesn't seem right to me.
Rental houses advertised as "rent-to-own" - scam or not? I'm looking for a rental for when I move this summer for a new job. I'm just graduating, so I don't have the work history to be considered for a mortgage yet, at least without a co-signer. Plus I don't think it's a good idea to just up and buy a house somewhere that you've never lived before, especially in this market (since you're stuck with what you get for a while). So I keep seeing these rental houses that are rent-to-own, where if you decide at the end of the lease to buy the house, they put the amount you've paid in rent towards your down payment. Generally, do these tend to be scams? I did notice that the rental rates are 20%-40% more than a mortgage payment would be, based on the fair market values of equivalent houses of the same size and location. That's what makes me wonder if, perhaps, the owners of these houses are trying to con people with bad credit or no savings into buying houses for WAY more than they're worth. I'll be an accountant in a few months so I'm not worried about getting scammed on a particular deal (i.e. I'll put the numbers and contract to the grindstone), but I'd like to know if I should even bother with the rent-to-own houses. If it's not a scam, it's a pretty sweet deal.

My landlord is selling the house before contract is up; how much $$$ should I ask for as a buyout? The home I am renting is very expensive; the landlord is selling it and would like us to move out before our contract ends. She did not tell us she was going to put it on the market when we signed the contract 3 months ago. I have a family of five and we are stressed out from just finishing up our cross-country move. I think the landlord should pay me to move out early, especially because my company is picking up the cost of the house through the end of the contract, but if I move out then I'm on my own. So I think the landlord should settle with me for at least the amount of the rent through the end of the contract, plus some amount of "inconvenience". Legally, I don't HAVE to move out until the contract is up. So is there a precedent for "inconvenience fee" of moving out early to help a landlord sell his/her house?
