can a homeowner sign a rent to own lease with me when there home is under contract with a realtor?

thanks for all the answers,but the owner said she could not let the realtor know that she is doing a rent to own with me, so why is that, if it is ok for her to do so

  1. I'm pretty sure it's fine. the client just isn't allowed to go behind the realtors back to make a deal that the realtor had previously shown to the client.
  2. The answer is yes, but.... If anyone wants to buy the house they would have to honor the lease including the option to buy. The rent to own contract will probably contain some language regarding your rights to exercise the option prior to the sale to any other purchaser. The terms of your option to buy may or may not contain verbiage about the price and terms. If the price and terms of you option are attractive enough, a buyer might want to buy the home at a lower price for cash hoping you will exercise your option at a higher price thereby insuring a reasonable profit.
  3. it depends on the listing agreement if it is an open buyer-agency agreement then yes they would be able to sign a rent to own option with you. This allows the seller to procure his own buyer and forgoe paying the Real estate salesperson and broker. If it is an exclusive-agency buyer-agency agreement she would not need to compensate the agent.However if it is and exclusive buyer-agency agreement the buyer is leagally bound to compensate the agent regardless of who located the property. So it may not be a good idea until the listing agreement is checked out.
