I a lessee wants out of his lease option agreement and improved the home but also removed fixtures ?
7 mos into a 12 month option lessee wants out. His home has not sold and he has asked me to resell the home but wants to stop paying lease. He also improved the house with out written permission garage doors/replace brand new carpeting with lighter color removed wood burning fireplace and a new propane stove along with the brick work under both stoves. he rplace those units with plug in fake fireplaces nice but ? he also installed a stackable w/d reventing etc. he has offered to give up the $5,000 option he has never lived in the home only was getting it ready when he did move in thye market is such that in this resort towne I may or may not be able to resell or lease quickly. what are my options thank you

- It is all according to what is written in the contract. Normally, any changes, modifications or repairs made by Lessee become part of the property-and is not included in any disposition or monies owed to them. Go back to your contract. Protect yourself....
- Tehnically, you are completely in the right, and he is in the wrong. As the owner of the home, you have full rights to go after this guy, and if he did not get written permission to improve the home, that his fault, too, and you get to maintain and keep the improvements. However, that depends on your contract I had a situation like that before with a guy, and I let him out, but not without him paying an "exit fee" which I now make a part of all my lease options, and typically, it is at the very elast 6 months worth of payments. Get an attorney and be ready to sue this guy.
