signing a lease to own while house is listed?

We have a house listed with a broker and the listing expires in 3 weeks. We have someone interested in signing a lease to own option contract. My question is I want to make sure we are able to sign the lease during the listing as long as the lease start date is AFTER the listing expiration, and there are no financial obligation to the broker at that time.   1. Check that with an attorney in your own state. You do not need incorrect information.
  2. Wait, or you may open a can of worms. What does the listing say?
  3. And somewhere in life do you want someone to treat you the same way. You would be a fool to sell rent to own without at leas an Atty to take a look at all contracts. Why do you want it signed beforethe listing expires? If you just wait a few days then you will probably be legit. What goes around comes around!
  4. Definately have a real estate lawyer take a look at all the paperwork before anyone signs. With what's listed here it sounds like it would work, but you don't want to run any risks when your home is on the line What about simply doing seller concessions and doing a sale instead of a lease option? Have you explored that option yet?
  5. If the lease is signed while the contract with the broker is still valid, you will have to pay the broker even if the lease starts after the listing is over. I recently signed with a realty company to sell my house and was told that is I sell the house on my own or such within 90 days of the contract, the broker COULD come back after their fees. Check the contract you signed with the broker and make sure what it says to be sure. Take the contract to a real estate attorney and have them look it over and let you know.
  6. Talk to an attorney. I would be careful, but look at your listing agreement, it should say when you are responsible for paying a commission, do not assume anything, especially if the lease people were introduced by the broker or found the property through the broker's advertisement. I would sooner get in between a bear and a baby cub before I would get between a real estate agent and their commission:>)
