do you have to serve someone with an eviction notice, if they are not on your lease or own the house?
here is the situation there is someone in my house and they won't leave even though i have asked them to. They have no lease with me and are not on the deed to my house. They told me they have 30 days and i have to serve them with an eviction notice. is this true or can i just kick them out now?

- Depends on the state you live in and residency; have they changed a drivers license to show your address as theirs? Are they paying a utility bill? If so, depending on where you live, you may have to file an eviction and it may take 7-90 days. Short cure? Call the police and have them tossed as trespassing. They will let you know.
- Once they have established residency....you would need to have them evicted through the courts. In some states this can be a lengthy process....taking anywhere from 1 to 6 months.
- I agree with the last answer. Ring up the police. If they say you need an eviction notice, then get one.
- If they receive any mail or have paid any sort of rent / provided any sort of service in exchange for living there you need to serve them with an eviction notice. Although, I would say calling the police and trying to have them tossed for trespassing is a reasonable thing to try. So is the whole 'change the locks, throw their crap outside' and see if they are going to go through the trouble of suing you. Just make sure they don't have established residency and aren't the kind of people who will sue you.
- If they are not on a lease or title to your house then they are trespassing and you can have them removed or arrested for this. The mail thing proves very little I could have my mailing address changed to my neighbors house but that don't make me a resident there in my neighbors eyes. In a court of law they have to be on the lease or title. Call the police they will steer you in the right direction.
- I would this person if they don't leave you're going to call the police. If they aren't on the lease and are staying as a guest, you have the authority to kick them out. I'm not totally sure on this though so if I were you, I'd call your local police and ask what they recomend you do. Good luck!
