Is a contract with a real estate agent impossible to get out of?

I recently signed a contract with a real estate agent to rent my house out. It is a 6 month contract, she brought exactly one person in to look at the house. She is now pressuring me to sell the house. Is there any way for me to get out of this contract? In addition, both I and my wife are listed on the deed (we both own the house), but only I signed the contract with the agent. Is this enough to break the contract with her?

  4. Yes. Your contract with her is for her to rent out your house. She has failed to do so. Does this contract state that you want her to sell the house? If not, tell her to get to work on her duties she agreed to in the contract. You should be putting the pressure on her! Good Luck!
  5. You don't say how long the listing agreement has been in effect or the nature of your market. If it is only a week old or you are located in a hard to rent area, one prospect may be a reasonable number. Also, the agent may have had a dozen calls & people were turned off because your rental rate may be too high for the area or you have a cement plant next door. The fact that she is pressuring you to sell would concern me, because she may be discouraging renters in order to encourage a sale listing. Even a single owner of a property can become obligated to a broker by contract -- especially on rental listing agreements. Most broker's won't take a sale listing unless all owners sign because they know they can't force non-signers to close. But multiple owners normally delegate one person to sign leases. Read the listing agreement to see if there is a clause requiring signature or consent by all owners. If not, you are probably stuck on the rental listing. An owner can terminate a listing of a broker who "abandons" the listing by not showing it. But that is a very difficult thing to prove. If termination is your goal, you'd best see a local attorney.
