Our HOA presidents insists we only 2 options: purchase or lease the clubhouse.?

Governing documents do NOT state we have to buy or purchase. Is it legal to insist the residents have to purchase or lease the common areas?

  1. Something is WAY off here. I am the current President of an HOA and also on the board at another HOA and The President CAN NOT force anyone to do anything. He needs to entire Board to review AND approve any transactions and ALL of the President's duties and actions are CONTROLLED by the CC&Rs and the By-Laws of the HOA. I am assuming that you have bought a unit in the HOA and subject to it's rules and regulations but a unit owner can NEVER be forced to purchase the common area and in fact the Board can NOT sell the common areas without a vote from ALL unit owners. I think you need to sit in on the next board meeting and doing the open forum ask for clariication on this issue. And during your purchase (closing documaents) you were supposed to get a copy of the CC&Rs, By-Laws, and all other regulations so either find them and read them before the meeting or request a copy of them from the Board.
